The importance and significance of self-regulation of learning has emerged as one of the most important development for explaining motivation and performance among learners. Self-regulation of learning refers to the process in which learners self-initiate thoughts, behavior, and feelings in order to pursue valuable academic goals. Self-regulation of learning involves three cyclical phases. During the forethought phase, learners, as proactive agents, engage in self-generating goals, strategic planning, intrinsic interest on tasks, and sustain self-efficacy beliefs. During the performance phase, learners initiate actions by which they enact volitional control and use strategies such self-instruction, imagery, self-monitoring, and attention control. During the self-reflective phase, learners initiate self-reflective processes in which they self-evaluate their performance, examine their attributions and self-reactions, and adapt their performance. Self-regulation of learning approaches investigate the contextual, environmental, and social cognitive factors that guide and promote learning. This special issue of Academic Exchange Quarterly features empirical and theoretical contributions dealing with improving students self-regulation of learning. This special issue of shows the many ways in which the cyclical phases and subprocesses of self-regulation of learning are currently taking place in multiple settings and learning conditions. Federal agencies seek improvement in quality in establishment surveysQuality in Establishment Surveys is a Federal report that examines the potential sources of error in Government surveys of business establishments. Not intended as either a springboard for defining standards or a means of evaluating current practices, the interagency report aims to provide survey practitioners with useful reference and guidance in designing and refining establishment surveys. Information for the report was garnered from a questionnaire concerning the survey design practices for 55 Federal establishment surveys from nine agencies. Errors occur in surveys at two possible points: in the sample design and estimation (sampling error) and in the survey methods and operations (non-sampling error). Errors of either variety can be variable, that is, randomly introduced and distributed, or instances of bias, that is, nonrandom, systematic error. Control of both of these is important to establishing the quality of the survey. Sampling error results from (1) the sample design itself and (2) the method of estimating the probability of occurrence in the entire population of a feature characterizing the sample population. The sample design may contribute to errors in a number of different ways. First, because establishment surveys are usually dominated by a select few units, differential sampling by establishment size is performed, often involving certainly selection for the larger units. In some cases, very small units may be given zero probability of selection and may thereby be altogether excluded from the target population. Second, conflicting design objectives may result in tradeoffs having to be made wherein reliability may be compromised, or at least not improved. For example, when detailed publication cells are required, the size of the sample must be increased, often without a concomitant increase in reliability in the aggregate cells. Finally, the requirement for revision and updating of the survey design may result in several kinds of error. Issues that must be faced during survey redesign involve the continuity, availability, and current analyzability of the data. In respect of the first of these, very often the usefulness of the data depends on longitudinal features as much as on current measurement. Errors resulting from sampling estimation have two sources: the actual estimator used and the approach to the estimation of variance used. As regards the former, there are four commonly used estimators, each with its own peculiar advantages and disadvantages. The direct expansion estimator, given by [Mathematical Expression Omitted] where Y [caret] is the estimated total, [W.sub.i] is the weight applied to sample unit i, and [Y.sub.i] is the reported value of sample unit i, has the advantage of being operationally simple, unbiased, and linear in its variance estimator. Its chief disadvantage is that is it not very efficient. The ratio estimator, [Mathematical Expression Omitted] where X and Y are at least moderately positively correlated features of the population of interest and X is the complete enumeration total of the [X.sub.i], is an improvement over the direct expansion estimator because of the existing correlation, but is biased due to its nonlinear form and confronts the researcher with the problem of deciding whether to use ratio estimates formed separately for each sampling stratum and then summed across all strata or formed for all the strata combined. The link-relative estimator, which is similar to the ratio estimator except that only reported values of [X.sub.i] and [Y.sub.i] are used and weights may not be included, is considerably biased in practice because the units reporting are rarely representative of the universe in question. The unweighted estimator is severely biased, even as regards trends, but is sometimes employed because it is simple and inexpensive to use.

In this paper, three metaheuristics are proposed for solving a class of job shop, open shop, and mixed shop scheduling problems. We evaluate the performance of the proposed algorithms by means of a set of Lawrences benchmark instances for the job shop problem, a set of randomly generated instances for the open shop problem, and a combined job shop and open shop test data for the mixed shop problem. The computational results show that the proposed algorithms perform extremely well on all these three types of shop scheduling problems. The results also reveal that the mixed shop problem is relatively easier to solve than the job shop problem due to the fact that the scheduling procedure becomes more flexible by the inclusion of more open shop jobs in the mixed shop. Keywords: Machine scheduling; open shop; job shop; mixed shop; metaheuristics. In combinatorial optimization, machine scheduling problems have been the subjects of extensive research since the early 1950s (Baker, 1974). Many of the early developments were motivated by problems arising in the area of manufacturing. The machine scheduling problems that we consider in this study can be described as follows: Given m machines and n jobs, the jobs are to be processed on the m machines. A schedule specifics, for each machine i and each job j, a time interval throughout which processing is performed on job j by machine i. A schedule is feasible if each job can only be processed on one machine and each machine can only process one job at a time, and also if it satisfies various requirements imposed on the jobs and machines relating to the specific problem type. According to the machine environment and job characteristics, machine scheduling problems can be divided into two production systems: single-stage system and multi-stage system. A single-stage system requires one operation for each job, whereas in a multi-stage system there are jobs that require operations on different machines. Single-stage systems involve either a single machine referred to as the single-machine scheduling problem, or m machines in parallel referred to as the parallel-machine scheduling problem. In multi-stage systems, there are three types of basic shop scheduling problems: the flow shop scheduling (FSS) problem, the job shop scheduling (JSS) problem, and the open shop scheduling (OSS) problem. In a flow shop, each job is processed on machines 1, . . . , m in this unidirectional fixed order. In a job shop, each job has a prescribed routing through the machines, but the routing for each job may be different. In an open shop, the routing through the machines is unrestricted and forms a part of the decision process. Most debates about lawyers professional responsibilities ultimately devolve into discussions of the “role” of lawyers-including the functions lawyers serve in the legal system, how lawyers should achieve those functions, and how lawyers should reconcile conflicts between competing interests that are potentially affected by their conduct. The notion of a lawyers role can be helpful for identifying principles of behavior. Thus, for example, whether attorney-client confidentiality is appropriate and whether exceptions should be acknowledged depends on the conception of lawyers from which one starts. If lawyers are to be clients sole and fully-allied champions, then strict confidentiality rules make sense. If lawyers are to be objective intermediaries between clients and society and have independent obligations to the law, exceptions seem more acceptable. The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted. Part I of this Article identifies some of the different images of lawyers that exist6 and the ramifications of emphasizing each image in the professional codes. Initially at least, this Article takes no position on the accuracy of the images in describing lawyer behavior-for example, whether lawyers act in a selfinterested manner or whether lawyers feel bound by unenforceable professional norms. As a practical matter, each of the images has solid footing in some respects. That is to say, each is based on a valid characterization of how lawyers act in some situations. Part I will suggest, however, that relying upon multiple paradigms inevitably fosters schizophrenia on the part of the code drafters.

In response to Dallen Allred (Readers Forum, Oct 13), why is it that those on the left cannot distinguish between legal immigration and illegal immigration? We want legal immigration because legals try to assimilate into American culture and learn English. It is good to have fresh thinking with new legal immigrants.
In speaking about immigration, people who advocate massive or unlimited immigration usually contend that immigrants make Americans wealthier because immigrants are a hardworking group who are not here for government handouts. These advocates add that immigrants do not take jobs from native workers and, in fact, create new jobs, benefiting all Americans. However, these claims are based on errors or misrepresentations. To begin with, this argument assumes a high level of education among immigrants. A report by the pro-immigration Cato Institute, which favors unlimited immigration, states: “The proportion of immigrants with a bachelor degree or postgraduate degrees is higher than the proportion of the native labor force”; hence, we are told, the immigrants are beneficial because intelligent people are innovative and create jobs. But while this finding and conclusion are based on the U.S. maintaining a relatively steady flow of illegal immigrants of 250,000 to 300,000 per year from countries all over the world, the actual immigration rate is an estimated one to three million per year, mainly poor Hispanics. And even the Cato report acknowledges that only 1.7 percent of immigrants from Mexico are in the “professional, executive, or manager” category. The report also ignores the fact that we get most of our well-educated immigrants through legal immigration. Similarly, the Cato report contends that past large-scale immigration of poorly educated immigrants has not hurt native workers. It uses as proof the fact that cities with a large influx of immigrants did not experience any significant declines in the employment rates of minorities and high school dropouts (those who would compete directly with illegal immigrants for jobs). But this very well could have been a case of employers moving to areas with large amounts of low-wage workers. If immigration does not hurt native workers because, as some people are fond of saying, immigrants “take jobs that Americans wont do,” the wage rates of natives should not be affected by immigration. In reality, according to the Center for Immigration Studies, “between 1989 and 1999, the real wages (adjusted for inflation) of workers who lack a high school education and work full-time year-round declined by 7.2 percent. [while] wages. of full-time, year-round workers who have completed high school rose 9 percent.” Approximately 8 percent of adult natives who work full-time are high school dropouts, but they make up approximately 26 percent “of full-time native workers living in poverty.” The increased competition for jobs by immigrants is lowering or stagnating pay levels for them, virtually ensuring that the native poor will stay in poverty. The pro-immigration lobby also errs in claiming that immigrants pay more to government in taxes than they use in government-provided services. In fact, large-scale waves of poor immigrants are devastating our countrys coffers through their use of means-tested programs (government handouts), causing hardships for Americans. Because low-wage workers qualify for most welfare programs and over 74 percent of illegal Mexican immigrants and their children are living in or near poverty, an inordinate percentage of them use welfare. Though the immigrants themselves are barred from using many of the welfare programs (not all), their U.S.-born children are immediately eligible to participate. “Whereas 14.8 percent of native households use at least one of the five major welfare programs, among households headed by an illegal alien from Mexico the figure is 24.9 percent,” states the Center for Immigration Studies. These statistics are from 1999, before we added millions of poor Hispanics to our countrys population. In 1999, over $300 billion was spent on the welfare programs. Last year, over $300 billion was spent on Medicaid alone.

American Burying Beetle (Nicrophorus americanus) The largest American burying beetle reintroduction effort in the 12-year history of the species recovery program took place recently on Nantucket Island off the Massachusetts coast. The Roger Williams Park Zoo in Providence, Rhode Island, raised well over 300 of the endangered beetles for release on Nantucket Island, a historic locality for the species. On June 11 and 12,320 American burying beetles (160 pairs) were given dead quail for food (the beetles require carrion to reproduce) and released at the Massachusetts Audubon Societys Sesachacha Wildlife Sanctuary. With each pair of beetles capable of raising 10-20 larvae, the 2001 release may result in thousands of beetles on the island by late fall. This effort is probably one of the largest reintroductions ever undertaken for an endangered insect species. Present to document the work was a film crew from the TV program, Wild Moments, and the Providence Journal newspaper. Partners in the work include the Rhode Island Division of Fisheries and Wildlife, Massachusetts Division of Fisheries and Wildlife, Roger Williams Park Zoo, Massachusetts Audubon Society, University of Massachusetts Boston Field Station, University of Rhode Island, Maria Mitchell Natural History Museum, and Nantucket Conservation Foundation. Indiana Bat (Myotis sodalis) As a result of a multi-agency partnership, endangered Indiana bats have been documented to migrate to the Lake Champlain Valley in Vermont from a hibernaculure in New York. Biologists tagged five Indiana bats (four females and one male) with radio transmitters as the bats left their hibernaculum (hibernation site) in early May. Three females were located by air and subsequently by land in Vermont within one to six days after release. Multiple roost trees for two of the females were identified; most of the roost trees were shagbark hickories. Evening counts of bats leaving the roosts ranged from 4 to 120 bats (probably more than one species roosted together). All of the Indiana bats were found on private land and all landowners granted permission for field staff to locate the bats. The success of this study was due to a substantial cooperative effort by state and federal agencies and concerned citizens. Staff and equipment were provided by our New England and New York Field Offices, the New York State Department of Environmental Conservation (which also provided the airplane and pilot), the Green and White Mountain national forests, and the Vermont Agency of Natural Resources. The West Virginia Department of Natural Resources loaned additional equipment. High school and college students also volunteered their time.

The Living Planet Aquarium may live to fight at least three more years. While Salt Lake City leaders thought they could kill the aquarium next month, the City Council learned Thursday that the aquarium may exercise an option it has to buy the Salt Lake City Redevelopment Agency land near 400 South and 500 West, where the aquarium is to be located. “I am writing on behalf of the Living Planet Aquarium to inform the RDA that the aquarium is considering exercising its option to purchase,” aquarium attorney David Wolf wrote to RDA Board Chairman Eric Jergensen Thursday. “In addition, representatives from the aquarium would like to meet with you, and the appropriate representatives of the RDA, to discuss how best to coordinate the sale of the property from the RDA to the aquarium.” The agency has an agreement to give the aquarium a free lease on the land if it could meet several semiannual fund-raising milestones established by the RDA. The aquarium, however, has failed to meet any of those milestones, and last April the City Council, serving as the RDA Board, gave the aquarium one last chance: If the aquarium could raise some $10 million or get a bond to fund part of the $47 million project on the Salt Lake County ballot by November, the agency would continue the lease.

LOS ANGELES — The ability of tire tread to perform in rain and snow is diminished as tires wear. With 2/32″ tread depth, the legally required minimum tread, resistance to hydroplaning at highway speeds is significantly reduced, according to the Automobile Club of Southern California. “Not being aware of the condition of the tires on your vehicle is dangerous,” said Dave Skaien, the Auto Clubs Approved Auto Repair Program Development Manager. “Sufficient tread depth and proper tire inflation is critical for safe driving in any condition. Eighty-six percent of drivers dont check their tire inflation pressure properly and 70 percent of U.S. drivers dont know how to tell if their tires are bald.” Many states have minimum tread depth laws. Dont drive on minimum tire tread before replacing your tires, said Skaien. Passenger cars shouldnt operate on tires below 2/32″ tread depth and ski-resort bound motorists should operate their vehicles snow tires on a minimum of 6/32″ tread depth. How do you know if your vehicles tires need replacing? A simple test is using a coin as a tire tread depth gauge. As tires wear, place an American penny into several tread grooves across the tire. If part of Lincolns head is covered by tread, then more than 2/32″ tread depth remains. On snow tires, if the top of the Lincoln Memorial is covered, then more than 6/32″ tread depth is left. (Be sure not to place the coin on top of the wear bar, a thick elevated strip of rubber running across the base of tire grooves.)
