Taxation of Personal Injury Awards Recent legislation, as part of the Revenue Reconciliation Act of 1989, may have settled some of the other areas of disagreement. The legislation provides that the exclusion for personal injury awards does not apply to any punitive damages in connection with a case not involving physical injury or physical sickness.(1) Thus, it would appear that all damages, both compensatory and punitive received for physical injuries will be excluded from gross income. Only compensatory damages received for non-physical injuries will be excludable from gross income. Punitive damages received for non-physical injuries will be taxable. The new provision is effective for amounts received after July 10, 1989, in tax years ending after that date, unless a binding agreement, decree or award is in effect before then. Despite the clarifying legislation, areas for disagreement between taxpayers and the IRS still exist regarding the nature of non-physical injury awards involving libel or defamation of character. Lets examine the statutory provisions, administrative pronouncements and judicial interpretations affecting the taxation of awards for libel or defamation of character.

One of the leading rainwater users is the local government in the Sumida ward of Tokyo. In the ward, 26 public buildings have facilities to utilize rainwater. In this area, there are nine regional rainwater utilization systems with underground tanks of three to five metric tons. The Ryogoku Kokugikan, a building that houses Japans primary sumo wrestling (Japans national sport) ring in the Sumida ward, has a total area of 35,700 square meters, with three stories above and two stories underground. A man accused of causing a fatal accident on the Bangerter Highway last April pleaded guilty Tuesday to one count of automobile homicide. Finhas Habib, 37, appeared in 3rd District Court to enter his plea to the second-degree felony.
Two auto-pedestrian accidents, one of them fatal, were among a spate of weather-related crashes Friday evening. Midvale Police Sgt. Ken Jarvis said an 89-year-old woman whose house is on the southwest corner of the intersection of 7720 South and 310 West was returning from the store just before 6 p.m. when she was hit, probably while in the crosswalk. THE GOVERNMENTS youth crime tsar has called for the scrapping of defence lawyers for child offenders amid fears that coaching by solicitors is leading young people to become career criminals. Lord Warner, the chairman of the Youth Justice Board, said lawyers were treating offenders as young as 10 as if they were adult clients, advising them to plead not guilty despite evidence to the contrary, and coaching them not to comment in interviews.

Since television networks began marketing the fruitful industry with makeover programs, popularity grew, and business skyrocketed.
The home, owned by Dr. David Garner, was approximately fifty years old and highly compartmentalized, according to Bonnie Wolke. Additionally, an attached garage had no direct access to the house; Garner had to leave the garage and enter the home through his front door. Therefore, the owner requested a new three-car garage be added on the other end of the home to give him direct access. After that first project, Garners vision for his home mushroomed into a total transformation of most of the living space, according to the Wolkes. Denny Wolke explained that the owner was very involved in the design and selection of products for the finished project. The changes were intended to open the house up and provide a sense of flowing space while still working within the limitations of space available.

They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs.

Among the diverse works on view, several resemble monstrances and suggest an ecclesiastical function. The oval Laos Mirror (2001), measuring 16 inches on its long axis, is fixed halfway up a 29-inch metal rod retained from the pouring process. Viewed from the pictorial side, the roughly 4-by-3-foot screen of Large Stainless Growth (2000) is composed of funguslike ripples that diminish in horizontal tiers, receding toward the upper edge. Its verso consists of two rods that emerge from cups and divide to form a structure resembling tree branches. The gaping surface of The Great Nipple Wreck of 2000 appears flayed, stripped back to reveal the lost canvas transformed to steel. The sculpture attracts the play of light and shadow. In a related show of drawings at McCoys Chelsea space, on view by appointment only, the largest pieces consisted of either black, graphite, indigo or burnt umber oilstick marks of controlled mastery, performed on considerable expanses of linen primed with lead white, installed directly on the wall. At more than 5 by 18 feet, the tour de force Black and White Mural (2003) is figured with marks that spiral out of circular openings in sweeping gestures. The lines of these large-scale works carry over the border and onto the wall. Where the passages of oil stick are applied with special force, the pigment takes on a dense, waxy sheen on the lead-white ground. Elsewhere, passages become more complex, with a subtle, scrolling pattern resembling rubbings from incised stone.
Falkenstein left California for France in 1950, and during the first two years of her Paris stay she spent the majority of her time making jewelry, mostly in copper, silver, and gold. It was the techniques learned as a jeweler–as well as the jewelers self-consciousness of the female body–that provided the greatest influence upon her sculpture. Falkenstein was the center of an active community of American expatriate artists in Paris, many of whom were also from California. But her reputation in France was secured through the support of art critic and theorist Michel Tapie. Tapie was the critical voice behind the movement Art Autre, which emerged during the postwar period in France as a critical antidote to prewar artistic traditions polarized between Geometric Abstraction and a revival of the French figurative tradition that echoed the “return to order” of the 1920s.During the years following World War II in Paris, the debate concerning the role of art in French society took on an urgency that could not have been predicted before the war. The threadbare arguments concerning the respective roles of figuration and abstraction that had plagued the French aesthetic world during the 1930s were all resuscitated.(2) The war had functioned as a historic sealant, and the questions of how to approach the future, and how to access the past, became central issues in the late 1940s. In the midst of the physical and moral devastation brought on by the war, French intellectuals of the period looked to culture as one avenue of salvation. Jean Paul Sartre, for example, maintained the importance of the literary act, which allowed some level of autonomy, or freedom, for the individual in a world that had lost all sense of meaning, justice, and morality.(3) But the difficulty came in determining exactly what cultural forms were still viable after the destruction of the war. The politics of artistic style became increasingly polarized during the latter part of the 1940s, with Geometric Abstraction becoming the bete noire of advanced French art, associated as it was with the foreign artists of de Stijl and Russian Constructivism, while the development of figural artistic practices was divided between conservative elements–those artists and historians who sought to maintain the French tradition–and the more politically radical concerns of the French Communist Party (Parti Communiste francaise, or PCF). After the war, Surrealism had been discredited due to the mass exile of its artists to the United States during the Occupation. This situation mirrored almost exactly the condition of French art-world politics at the end of World War I, when prewar avant-garde art practice became synonymous with foreign culture. Just as with the end of World War II, in 1919 nationalism became, in the words of art historian Kenneth E. Silver, “less a matter of content than of form; less a subject for art than a style.”(4)

My own practice was constructed as a part of the local group of health care practitioners in my community. I sought out the best primary care physicians, physical therapists, neurosurgeons, orthopedic surgeons, and physiatrists to associate with, and referred to them when it was clear that my form of intervention was not helping the patient. In this sense, I was an “integrative chiropractor” because I saw to it that the patients best interests were served in two ways. First, the patient received the best conservative care first (chiropractic) before moving on to procedures of greater risk. Secondly, the patient was free to talk openly with me and with the medical providers about all the practitioners involved, without fear of derision or embarrassment. No one was competing for the business of the patient; we were only working as a team for the patients welfare. My network included the chiefs of staff of local hospitals and spinal orthopedics at Stanford University Hospital, the best orthopedist for knees and shoulders, the best family practice physicians, and so on. Therefore, I could honestly say to the patient that he or she was getting the best care possible.
The Chiropractor, however, would be one of the longest lasting and best known of chiropractic periodicals (continuing in monthly publication until November/December 1961), and serving multiple functions along the way. Not the least of these would be its role as the “official organ” of the several professional societies BJ. founded and led: the Universal Chiropractors Association (todays ACA) and the Chiropractic Health Bureau (todays ICA).The masthead indicated that the new periodical was published by the Palmer School of Chiropractic and copyrighted by B.J. Palmer. Single copies were available for 5 cents each, or a years subscription for 50 cents, “which may be sent in postage stamps.” The first issue listed a number of articles on its cover:

Nursing home care in Utah is improving, the Centers for Medicare and Medicaid Services reported Wednesday. Many of those improvements were linked directly by care center administrators to a quality improvement project through HealthInsight, Medicares Quality Improvement Organization in Utah. The organization is part of the national Nursing Home Initiative, which focuses on raising standards of care in nursing homes across the country and giving consumers more comparison information.
For years, Remodeling magazines annual “Cost vs. Value Report” has offered comfort to homeowners investing hefty dollars into home improvement projects. The high payback on the most popular rehabs - kitchens and bathrooms - has even been the catalyst to spur some homeowners to remodel. They felt confident that if they did good work, theyd get back most of their funds. Does this mean that homeowners should stop renovating? Christmas lights started appearing on houses in my neighborhood the weekend before Thanksgiving. By this past weekend, many more homes, yards, fences, bushes and trees wore sweaters of wire and flickering lights. Lawns were littered with plastic Santas, candles and nativity scenes. Decorative lighting for Christmas has become a suburban sport and we have Thomas Edison to thank — or blame, depending on your point of view.
I rather like the fact that the City of London is giving a refreshingly new twist to Christmas lights, by having artists devise theirs. The Citys streets will be illuminated by hi-tech installations, but they will be at street level, not way above our heads. One thing, though. Which celebrity will be inclined to go down into the sewers to switch on this novel light installation? Its a dirty job but someone has to do it in the spirit of Christmas. Could this perhaps be the moment for the long-awaited comeback by the Spice Girls?
