Back in the old days, when a lawyer or lawyers helper needed to bone up on a particular point of law, he or she would enter a place known as the “library” and consult something called a “book.” Thats the way it was in 1983 when Charles McCowan helped launch Kean, Miller, Hawthorne, DArmond, McCowan Jarman. Maybe law books arent that obsolete yet, but theyre close. Everythings gone electronic for crying out loud. “Now the bulk of people here use computerized research, except us dinosaurs who dont know how to do it,” McCowan says.
The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted.

The hearing for Michael Todd Smith, 32, was delayed because the county district attorneys office has not filed formal charges. Smith is the owner and instructor at T-Kanes Kung-Fu and Karate in Livermore. He was arrested on suspicion of two counts of lewd acts with a minor, which are felonies, and annoying or molesting a child, a misdemeanor.

After reading Toms Top Tips, in the July issue, I feel compelled to add what I think should have been the No. 1 tip. Although I dont live 24/7 on a boat (nor do I want to) I know that cruising can take you to many remote places. My No. 1 tip would be to advise all considering such cruising, to become proficient in advanced first aid. Perhapsbecome an EMT or a paramedic, and have a full supply of first aid equipment on board. Chicago Bulls guard Jay Williams recently suffered severe injuries in a motorcycle accident in Chicago. Williams, 21, injured his knee and pelvis in addition to breaking his leg, the Associated Press reported. Also, he reportedly sustained nerve damage to his left leg and has a torn anterior cruciate ligament. Williams underwent surgery at Illinois Masonic Hospital. A 30-year-old man died early Saturday, and another man was critically injured after a two-motorcycle accident at Circle Drive and Holiday Place. Police identified the man who died as Dwayne Norris. The second man, Steven Sullivan, 37, was in critical condition at a local hospital, police said. The crash happened about 1:30 a.m. The motorcycles appeared to be traveling east on Circle Drive, a witness said, declining to provide more details Saturday. A neighbor who lives next to the crash site said he saw a man lying dead in the street, and the other motorcycle was about 100 yards farther down Circle.

A review of the marketing literature in both the traditional (offline) and new era (online) environments was undertaken to compare and contrast marketings role in both types of organisation. Insights derived from this review formed the basis for a series of in-depth interviews with leading marketing professionals in Ireland. The paper draws conclusions regarding the overall effect of the Internet on marketing. Nashville, Tenn. - TNN canceling several series — The Nashville Network is canceling some country music-oriented programming, including the talk-variety format that has been its prime-time flagship for 16 years. Executives at the cable network Monday confirmed reports that “Prime Time Country with Gary Chapman” would stop production in September. Three entertainment magazine shows that focus on country singers also are being canceled: “Crook Chase,” “Crook Chase Tonight” and “This Week in Country Music.”

variety, and moderation in food choices.
It would be hard to find anyone in the United States or in any other part of the Western world who has not at one time gone on a weight-loss diet. Perhaps the most long-lived fad of our society the diet craze has grown and expanded its influence until almost every issue of every popular publication contains at least one diet article and television talk shows regularly feature diet gurus and those offering weight loss testimonials. With little evidence that such diets work and with quite a bit of evidence to the contrary a multi-billion dollar industry has grown up around the modern obsession with thinness. Women are the vast majority of consumers in the diet industry and though men do diet it is almost exclusively women who focus a significant portion of their time and energy on the effort to become thin.Though Americans are constantly bombarded with the concept of thinness as an ideal of health and beauty it is a relatively new concept that would have seemed laughable just one hundred years ago. Though standards of beauty have varied from culture to culture and from century to century plumpness has widely been viewed as signaling health success and sensuality. Many modern cultures do not place the same value on thinness as much of western society. Some such as those in Polynesia and east and central Africa value fat women to the extent of fattening up daughters to make them more marriageable.
DietingThe recommended approach to dieting for weight loss is to eat in moderation so as to control calories (do not go below 1,200 per day) and to increase activity to lead to a gradual, safe weight loss. A recommended method is to decrease calories each day by 125 (the amount in a small soft drink or full cup of juice) and to increase energy expenditure by 125 (walking for about 30 minutes). That is, a 250-calorie deficit a day should result in about a one- to two-pound weight loss over the course of a month. The goal is to slowly change eating and exercise routines and maintain a lifelong healthy weight. Quicker weight losses are hard to maintain. Most people can lose weight on any diet, even on fad diets, but the trick is to keep the weight off.So-called fad diets are diets that come and go in the marketplace and are typically deficient in various ways. For example, they may lack variety (e.g., the Grapefruit Diet, the Cabbage Soup Diet), be too low in calories and protein (the Rice Diet), and/or simply too bizarre (the Rotation Diet for food allergies ). People should be especially wary of any breakthrough quick-fix diets. If a diet sounds too good to be true, it probably is.

WASHINGTON — Construction of new homes and apartments plunged by 17.6 percent in March, the biggest decline in 14 years and another possible indication that rising interest rates are beginning to take a toll on the economy. Meanwhile, wholesale inflation shot up 0.7 percent as energy prices soared. The Commerce Department reported Tuesday that builders started construction on new homes and apartments at a seasonally adjusted annual rate of 1.84 million units in March, down from 2.23 million units in February. “This is a bit of a shocker,” said David Seiders, chief economist for the National Association of Home Builders. “But I dont think this represents a fundamental downshift in the housing market. There were special factors behind it.”
Colorado Springs-area home construction continued its blistering pace in the first quarter, although one economist fears an oversupply could drive down prices in the next few years. Single-family home building permits totaled 1,392 from January through March — a 20.2 percent jump from the same period last year, according to figures released Friday by the Pikes Peak Regional Building Department. Analysts had expected a 1.9 percent decline. The housing report showed that resales fell in the Midwest and West, rose in the South and showed no change in the Northeast.

In five consolidated cases, passengers alleged airline negligence for personal injuries they received when ( 1) luggage fell from an overhead compartment, striking a passengers head; (2) a woman did not receive the disembarking assistance she requested and was then injured while exiting the plane; (3) a flight attendant hit a passengers shoulder with a service cart; (4) a passenger tripped over luggage allegedly left in the aisle by a flight attendant; and (5) a passenger fell while boarding a motel shuttle bus after being denied passage by an airline. The trial courts held the suits involved the rendering of “services” and were preempted by the ADA. Reversing, the Ninth Circuit noted that although the LI Supreme Court has never defined “service” under the ADA, it has indicated in two cases that the ADA does not preempt most state law tort claims. The court here said that Congresss purpose in enacting the ADA was to achieve economic deregulation of the airline industry. The purpose of the statutes preemption clause is to avoid interference with that deregulation. Nothing in the statutes language or its legislative history indicates that Congresss purpose was to displace state tort law in actions that do not affect deregulation in more than a peripheral manner, the court said. As further support, the court noted the ADA still requires airlines to maintain insurance to pay for bodily injuries to or the death of any person for which they may become liable.

Senior workshops/ One way to help seniors prevent injuries is to couple education with exercise that improves strength and balance. He learns to depend on the physician in sickness and in health. He turns into a lifelong patient.” “Medicalizing” is forcing conditions into familiar diagnostic categories for medical management.1 Every complaint has an antidote, whether it needs one or not. ; Treating natural consequences of living as diseases that must be vanquished, leads to too much treatment and too much dependence on the authoritative “professional.” We tend to grant most, if not all of our decision-making authority to an expert in highly complex technologies. In the case of medicine, this often complicates the commonplace condition and prolongs selflimiting ones. Today, diseases and drugs are way oversold.

The health care industry generated more than $942.5 billion in expenditures in 1993, and employed more than 10 million people including 2 million nurses, more than 650,000 doctors, and 150,000 dentists. The industry supports 126 medical schools and approximately 6,600 hospitals; 1,100 health insurance companies; and 25,600 nursing care facilities. The nations health care services industry includes thousands of independent medical practices and partnerships, as well as public and non-profit institutions, and major private corporations. Americas complex health care system is a leader in the use of sophisticated and expensive technology.
“There are [more than] 30 million Americans who have no health insurance and another 20 million who have inadequate health insurance,” says Rep. Louis Stokes (D0Ohio), chairman of the Congressional Black Caucus Health Brain Trust. “It is mandatory that we begin to try and give Americans–particularly minorities–adequate health care as a right.” The Bush plan would give people not covered by Medicaid tax credits, and families making less than $80,000 a year tax deductions to pay for medical costs. He would also pass laws to ensure that even chronically ill patients could receive health insurance. The plan has received a cool reception on Capitol Hill, and alternate proposals, including a full-scale, government-paid national health insurance plan, are under development. But what does America really want for its health care system? The views are many.

A man accused of causing a fatal accident on the Bangerter Highway last April pleaded guilty Tuesday to one count of automobile homicide. Finhas Habib, 37, appeared in 3rd District Court to enter his plea to the second-degree felony. Police reported Habib ran a red light and hit a pickup truck, knocking it off the road and into a ditch. The trucks driver, Chad L. Hayward, was killed, and two passengers in Habibs car were injured.
SURPRISE, Ariz. — Giants infielder Rich Aurilia had a headache and felt the mild effects of whiplash after he was involved in an auto accident in Scottsdale on Tuesday morning. Aurilia said he was driving on Scottsdale Road to pick up his equipment bag when another driver rear-ended him. He was scratched from the travel list to Surprise, where the Giants lost 4-3 to the Texas Rangers. “Im hoping everything is all right,” he said. “My head is already feeling better.. It was one of those things. The guy in front of me stopped short like he missed his turn, so I stopped short. The guy behind me didnt.”
As part of an effort by Salt Lake Mayor Rocky Anderson and the city police department to promote pedestrian and bicycle safety, accident statistics were released Friday. The data showed 14 auto-pedestrian accidents last month in the city, including one that was fatal. Four auto-bicycle accidents occurred, but no one was seriously injured. In addition, officers issued 33 citations to motorists for pedestrian infractions, such as crosswalk violations, and 22 tickets to pedestrians for violations such as jaywalking.

Gene Veno: DCs Person of the Year Of course, unity is nothing new to Gene Veno. As executive director of the Pennsylvania Chiropractic Association, he helped unify the chiropractic profession in the Keystone State; then he helped do the same for chiropractors in neighboring New Jersey. In June 2005, he began addressing the need for a unified purpose and message on a national level. According to Mr. Veno, the Campaign for Chiropractic is a three-phase project:
For the longest time, the chiropractic profession has been trying to convince payers (particularly managed care organizations) that chiropractic care is not an “add-on,” but is actually a replacement for more expensive/invasive forms of care. This is at the heart of our argument that chiropractic care saves money by providing patients with a safer, more cost-effective alternative.Finally, a research study has confirmed what weve been saying all along. The results of a recent study that appeared in the Journal of Occupational and Environmental Medicine “indicate that patients use chiropractic care as a direct substitution for medical care.”1This four-year descriptive study was conducted from April 1997 to March 2001. The study wasnt a survey; the investigators used actual claims data from a large regional managed care network in California.
